StoryForge Terms of Service (Updated)

These Terms of Service (the "Terms") are a legally binding agreement between you and StoryForge Inc. ("StoryForge," "Company," "we," "us," or "our") governing your access to and use of the StoryForge website, mobile or web applications, and related services, features, content, and functionality (collectively, the "Services").

By accessing or using the Services, creating an account, clicking to accept these Terms, or otherwise indicating your assent, you agree to be bound by these Terms and by any policies or supplemental terms expressly incorporated by reference, including our Privacy Policy, AI Statement, and our Content and Community Standards. If you do not agree, do not access or use the Services.

1. Eligibility and Accounts

1.1 Minimum Age

You must be at least 13 years old to use the Services. The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that a user is under 13, we will terminate that account and delete associated data.

If you are at least 13 but under the age of majority in your jurisdiction, you represent that your parent or legal guardian is aware that the Services contain creative and literary works that may address mature, difficult, or sensitive topics, and that such works are identified with content warnings prior to reading. We reserve the right to require verification of parental consent at any time and to terminate accounts where such consent cannot be confirmed.

1.2 Financial Features

Certain features involve payments, Credits, cash-out functionality, or financial account information, including Feedback Bounties. To purchase Credits, create paid Feedback Bounties, receive cash payouts, or connect financial accounts, you must meet any additional eligibility requirements we or our payment providers impose, which may include completing identity verification or satisfying bank-account or tax-reporting requirements. Users under the age of 18 may use Credits to create Feedback Bounties or exchange Credits for Quills, but may not cash out Credits for money without the participation and authorization of a parent or legal guardian, as described in Section 8.12.

We may limit, suspend, or deny access to financial features at any time if you do not satisfy those requirements or if we reasonably believe doing so is necessary for legal compliance, fraud prevention, platform integrity, or risk management.

1.3 Account Registration and Security

You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. You may not share your account, impersonate another person, or create an account using false or misleading information.

You must notify us promptly at help@storyforge.com if you believe your account has been compromised.

1.4 Account Suspension and Termination

We may suspend, restrict, or terminate your account or access to all or part of the Services at any time, with or without notice, if we reasonably believe that:

  • you have violated these Terms, our Privacy Policy, or our Content and Community Standards;

  • you have used the Services unlawfully, fraudulently, abusively, or in a way that creates risk or potential legal exposure for StoryForge or others;

  • your account information is inaccurate, misleading, or no longer current;

  • you have repeatedly infringed the intellectual property or other rights of others; or

  • suspension or termination is necessary to protect the Services, users, StoryForge, or third parties.

You may stop using the Services at any time. Sections that by their nature should survive termination will survive, including sections regarding intellectual property, licenses already granted, payments, dispute resolution, disclaimers, limitations of liability, indemnification, and enforcement.

2. Changes to the Services and These Terms

We may modify the Services from time to time, including by adding, removing, or changing features. We may also revise these Terms.

If we make a material change to these Terms, we will post the updated Terms and update the "Last Updated" date. Material changes will become effective on the date stated in the updated Terms. By continuing to use the Services after the effective date of updated Terms, you agree to the revised Terms.

Any changes to dispute resolution provisions will not apply to disputes for which the parties had actual notice before the revised Terms became effective, unless applicable law permits otherwise.

3. User Content; Ownership; Licenses

3.1 Your Ownership of Your Content

As between you and StoryForge, you retain ownership of any stories, chapters, comments, feedback, profile content, messages, images, text, or other content you submit, post, publish, upload, transmit, or otherwise make available through the Services (collectively, "User Content"), subject to the rights and licenses you grant in these Terms.

3.2 License You Grant to StoryForge

To operate, provide, improve, secure, moderate, and promote the Services, you grant StoryForge a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, format, modify solely for technical or display purposes, transmit, display, perform, distribute, and otherwise use your User Content as reasonably necessary to:

  • provide and operate the Services;

  • make your User Content available in accordance with your sharing settings and feature choices;

  • enable community interactions and Feedback Bounties;

  • moderate, review, investigate, prevent, or address fraud, abuse, security issues, or legal violations;

  • create backups and maintain business continuity;

  • improve the Services, including testing, debugging, and developing new features; and

  • market and promote the Services, but only to the extent your User Content is publicly available on the Services or you otherwise make it available for public display.

This license ends within a commercially reasonable time after your User Content is removed from the Services, except to the extent:

  • your content has been shared with others and they have not deleted it;

  • the content has been used in aggregated or de-identified form;

  • retention is reasonably necessary for backups, legal compliance, dispute resolution, fraud prevention, or enforcement of these Terms; or

  • continued display is required for the operation of Feedback Bounties, moderation records, or completed transactions.

3.3 Rights You Grant Other Users

When you make User Content available to other users through the Services, you grant those users a limited, non-exclusive, revocable license to access and use that User Content only as enabled by the Services and these Terms. This includes reading, viewing, responding, commenting, and, where applicable, providing feedback through the Services. No user receives any ownership interest in your User Content solely because you share it or because a Feedback Bounty is attached to it.

3.4 Feedback and Suggestions

If you provide suggestions, ideas, enhancement requests, or other feedback about the Services themselves, you grant StoryForge a non-exclusive, perpetual, irrevocable, worldwide, royalty-free license to use and exploit that feedback for any lawful business purpose without compensation to you.

3.5 Your Representations About User Content

You represent and warrant that:

  • you own or control all rights necessary to submit your User Content and grant the licenses in these Terms;

  • your User Content, and your use of the Services in connection with it, do not violate any law or these Terms;

  • your User Content does not infringe, misappropriate, or otherwise violate the intellectual property, privacy, publicity, contractual, or other rights of any person or entity; and

  • if your User Content includes third-party material, you have obtained all rights, permissions, and consents necessary for that use.

3.6 No Confidentiality Obligation for User Content

The Services are designed for sharing and collaboration. Except as expressly stated in our Privacy Policy or otherwise agreed by StoryForge in writing, you should not submit User Content that you expect us to treat as confidential.

3.7 Platform Attribution

You grant StoryForge a perpetual, non-exclusive, royalty-free license to identify your User Content by title and to identify you as a StoryForge user or author for the purpose of describing, promoting, or publicizing the Services, including after your User Content is removed from the Services. This attribution right does not include the right to reproduce, distribute, or display the substantive content of your User Content.

4. StoryForge Intellectual Property

The Services, including their software, design, layout, user interface, branding, trademarks, logos, graphics, compilations, and all content created by StoryForge, are owned by StoryForge or its licensors and are protected by intellectual property and other laws. Except for the limited rights expressly granted in these Terms, no rights are granted to you.

You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, transmit, sell, license, reverse engineer, scrape, or exploit any part of the Services except as expressly permitted by these Terms or by applicable law.

"StoryForge," the StoryForge logo, "Quills," "Draft the Cat," and other names, marks, logos, and slogans used in connection with the Services are trademarks or service marks of StoryForge or its affiliates, whether or not registered. You may not use any of these marks without prior written permission from StoryForge.

5. Prohibited Conduct; Platform Permissions; Moderation

You may use the Services only for lawful purposes and in compliance with these Terms, our Content and Community Standards, and applicable law. Without limiting the foregoing, you may not:

  • use the Services in a way that violates any law or regulation;

  • exploit, harm, or attempt to exploit or harm minors;

  • post or transmit content that violates our Content and Community Standards;

  • impersonate any person or entity or misrepresent your affiliation;

  • interfere with or disrupt the Services or any server, network, or system used to provide them;

  • attempt to gain unauthorized access to the Services or other users' accounts or data;

  • use bots, scrapers, spiders, automated systems, or other means to access, monitor, copy, or interact with the Services without our prior written consent;

  • upload malicious code or engage in denial-of-service attacks or similar conduct;

  • use the Services to spam, phish, harass, stalk, threaten, defame, or invade privacy;

  • circumvent technical limitations, access controls, or security measures;

  • use the Services or User Content to train, fine-tune, test, or improve machine learning or artificial intelligence models except as expressly permitted by StoryForge in writing; or

  • engage in any conduct that, in our reasonable judgment, threatens the integrity, safety, fairness, or availability of the Services.

We may, but are not obligated to, monitor the Services, investigate violations, remove or refuse to post content, restrict access, preserve evidence, cooperate with law enforcement, and take any other actions we reasonably deem appropriate to enforce these Terms and protect the Services and our users.

6. Copyright Complaints and DMCA Policy

StoryForge respects intellectual property rights and expects users to do the same. If you believe content on the Services infringes your copyright, you may send us a notice containing the information required by the Digital Millennium Copyright Act ("DMCA").

6.1 DMCA Agent

StoryForge may update this contact information from time to time by posting updated information in the Services or on its designated copyright page.

6.2 Required Information

Your notice must include substantially the following:

  • identification of the copyrighted work claimed to have been infringed;

  • identification of the allegedly infringing material and information reasonably sufficient to permit us to locate it;

  • your name, address, telephone number, and email address;

  • a statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;

  • a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf; and

  • your physical or electronic signature.

If you submit a knowingly false claim, you may be liable for damages, including costs and attorneys' fees.

6.3 Counter-Notice

If you believe content you posted was removed or disabled by mistake or misidentification, you may send a counter-notice containing the information required by applicable law. If we receive a valid counter-notice, we may restore the material as permitted or required by law.

6.4 Repeat Infringers

In appropriate circumstances, we may suspend or terminate the accounts of users who repeatedly infringe the intellectual property rights of others.

7. Third-Party Services and Links

The Services may contain links to third-party websites, tools, processors, or services, including payment, banking, analytics, hosting, or communication services. We do not control and are not responsible for third-party services or their content, practices, or policies. Your use of third-party services may be subject to their own terms and policies.

8. Purchases, Payments, Credits, Quills, and Feedback Bounties

This Section 8 applies to purchases, Credits, Quills, Feedback Bounties, rewards, cash-out functionality, and related financial features.

8.1 Payment Processors and Financial Providers

StoryForge may use one or more third-party payment processors, payout providers, or banking partners to process purchases, payouts, identity verification, tax reporting, currency conversion, and related services. By using financial features of the Services, you authorize StoryForge and its service providers to collect, receive, process, store, and share information reasonably necessary to provide those features and comply with law.

8.2 Credits

Credits are digital units used within the Services for designated platform features, including creating Feedback Bounties and other uses we may make available. Credits may be obtained in one or more ways that we authorize, including purchase from StoryForge or award through participation in Feedback Bounties.

Except where required by law or expressly stated by StoryForge, Credits:

  • are licensed, not sold;

  • have no property interest outside the Services;

  • are non-transferable except through the functionality we expressly provide;

  • are not redeemable or refundable except as required by law or expressly permitted by StoryForge; and

  • may be modified, discontinued, or subject to additional rules at any time.

We may set or change pricing, purchase minimums, expiration rules if any, usage rules, and other conditions for Credits at any time, subject to applicable law.

8.3 Quills

Quills are separate in-platform units used for cosmetic, customization, or other in-platform purposes designated by StoryForge. Quills are not redeemable for cash, are not bank accounts or stored value accounts, and do not represent a deposit or property right. If we permit conversion from Credits to Quills, that conversion is final unless otherwise required by law.

8.4 Feedback Bounties Overview

A Feedback Bounty is a feature through which an eligible user offering a publicly shared story or chapter (the "Author") may post a request for reader feedback and designate a stated reward to be awarded to one eligible response. Users who submit responses to a Feedback Bounty ("Responders") may be considered for the stated reward subject to these Terms, our Content and Community Standards, and any feature-specific rules displayed in the Services.

StoryForge provides the platform and feature functionality for Feedback Bounties but is not a party to the underlying creative or evaluative exchange between Authors and Responders.

8.5 Eligibility for Feedback Bounties

We may set eligibility requirements for creating, responding to, winning, receiving, or cashing out Feedback Bounties, including requirements based on account standing, geography, age, verification status, payment-provider requirements, and compliance or fraud review.

We may limit or prohibit participation in Feedback Bounties in certain jurisdictions or circumstances.

8.6 Public Content Requirement

To be eligible for Feedback Bounties, the applicable story, chapter, or other content must be shared in the manner required by the Services, which may include public visibility. StoryForge may change feature requirements from time to time.

8.7 Author Discretion and Winner Selection

Unless otherwise expressly stated by StoryForge, the Author has discretion to select the winning response from eligible responses submitted during the bounty period. The Author's selection is subject to StoryForge's rights to review, delay, reverse, void, or decline to honor a selection where we reasonably suspect fraud, abuse, collusion, manipulation, policy violations, technical error, payment failure, chargeback risk, legal noncompliance, or other conduct inconsistent with the integrity of the Services.

No Responder is guaranteed to win a reward merely by submitting a response. StoryForge does not guarantee that any response will be useful, accurate, complete, or satisfactory to the Author.

Default Winner Selection. If an Author does not select a winning response within approximately 24 hours following the close of the bounty period, StoryForge staff or authorized Story Scouts may designate a provisional winning response on the Author's behalf. A provisional selection is not visible to Responders or the public and does not constitute a final award. The Author retains the right to override any provisional selection at any time before the bounty's final resolution deadline. If no Author override is made before that deadline, the provisional selection, if any, becomes the final winner and the associated Credit award will be processed. If no provisional selection is made and no final winner is selected by the applicable deadline, StoryForge may, in its sole discretion, cancel the bounty and return the reserved Credits to the Author, extend the review period, or resolve the bounty in another manner consistent with these Terms and the integrity of the Services. StoryForge is not obligated to designate a provisional winner and does not guarantee that every bounty will result in a winner or a Credit award.

8.8 Responder License for Feedback

By submitting a response, comment, critique, answer, or other feedback through a Feedback Bounty, the Responder grants the Author and StoryForge a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and otherwise use that feedback within the Services in connection with the relevant story, chapter, bounty, moderation, dispute review, and operation of the Services.

Except for the limited license above, Responders retain ownership of their original feedback. Submission of feedback does not give the Responder any ownership interest in the Author's underlying story, chapter, or other User Content.

8.9 No Transfer of Copyright or Publishing Rights

Creating, funding, responding to, winning, or awarding a Feedback Bounty does not transfer any copyright, trademark, patent, trade secret, co-authorship status, publishing right, adaptation right, moral right, or other ownership interest in any User Content unless the parties separately agree in a written contract outside these Terms.

8.10 Bounty Funding, Reservation, and Award Timing

When an Author creates a Feedback Bounty, we may immediately charge, reserve, deduct, or place a hold on the applicable Credits or other value associated with that bounty. Credits reserved for a bounty may remain unavailable for other uses until the bounty is completed, cancelled, voided, or otherwise resolved.

StoryForge will endeavor to award Credits to a winning Responder within three (3) business days after the bounty's final resolution. This timeline may be extended without limit if the award is subject to review under Section 8.12, including where StoryForge suspects fraud, abuse, policy violations, or other conduct warranting investigation. StoryForge is not liable for delays resulting from payment provider processing times, identity or tax verification requirements, or circumstances outside our reasonable control.

8.11 Cancellations, Voids, and Refunds

Authors may cancel a Feedback Bounty only to the extent permitted by the Services at the time of cancellation. Unless the Services expressly allow otherwise, once an eligible response has been submitted, a Feedback Bounty may not be cancelled unilaterally by the Author. StoryForge may establish rules governing whether and when a Feedback Bounty may be edited, cancelled, refunded, or voided.

Without limiting the foregoing, StoryForge may cancel, void, or reverse a bounty or related reward, and may issue or deny refunds or credit reversals, if we reasonably determine that:

  • the bounty violated these Terms, our Content and Community Standards, or any feature-specific rules;

  • the bounty or response involved fraud, collusion, self-dealing, duplicate accounts, vote manipulation, artificial or automated responses, or other abuse;

  • the funding transaction failed or was later reversed, disputed, or charged back;

  • there was a material technical or administrative error; or

  • doing so is necessary to comply with law, enforce these Terms, or protect the integrity of the Services.

8.12 Cash-Outs and Payout Eligibility

Where StoryForge offers cash-out functionality for eligible Credits, access to that functionality is subject to all applicable rules, provider requirements, identity verification, tax documentation, sanctions screening, processing fees, currency conversion terms, and technical limitations imposed by StoryForge or its payment providers.

Cash-out requests are subject to a minimum payout threshold. StoryForge will not process cash-out requests below the minimum threshold displayed in the cash-out flow at the time of your request. You may accumulate Credits over time before initiating a cash-out.

Geographic Availability. Cash-out functionality is available only in jurisdictions supported by StoryForge's payment providers at the time of your request. The current list of supported cash-out regions is available at https://stripe.com/global. StoryForge does not guarantee cash-out availability in any particular jurisdiction, and supported regions may change at any time as payment provider coverage expands or contracts or as StoryForge adds or removes payment providers. If your jurisdiction is not currently supported, you may still earn and hold Credits and use them for other purposes within the Services.

Minors. Users under the age of 18 may not initiate a cash-out independently. To cash out Credits, a user under 18 must have a parent or legal guardian who participates in and authorizes the transaction, including by providing any bank account, identity verification, or other information required by StoryForge's payment providers. By authorizing a cash-out on behalf of a minor, a parent or legal guardian agrees to these Terms and represents that they are the minor's parent or legal guardian and are authorized to act on the minor's behalf. Users under 18 who are unable to obtain parental or guardian authorization for cash-out may still use Credits to create Feedback Bounties or exchange Credits for Quills.

We may refuse, delay, hold, condition, cancel, or reverse any payout or cash-out request if:

  • you fail to satisfy verification, identity, or tax documentation requirements;

  • your account is under review, suspended, or not in good standing;

  • we suspect fraud, abuse, money laundering, sanctions issues, chargeback risk, or policy violations;

  • the cash-out amount or pattern of activity triggers review under our fraud detection or risk management processes;

  • our payment providers or financial partners are unable or unwilling to process the transaction; or

  • we believe the payout would violate applicable law or expose StoryForge or others to unreasonable legal or financial risk.

Larger cash-out requests may require additional review, verification, or documentation before StoryForge processes them. We do not guarantee any specific timeline for completing review of flagged or elevated cash-out requests.

You are solely responsible for all taxes associated with your purchases, rewards, cash-outs, or use of the Services, except to the extent StoryForge is legally required to collect, withhold, remit, or report amounts on your behalf.

8.13 Fees, Processing, and Currency Conversion

Purchases, cash-outs, and other financial transactions may be subject to fees, commissions, processing charges, or currency conversion terms imposed by StoryForge, by our third-party payment providers, or by both. Applicable fees and any currency conversion terms will be disclosed in the checkout flow, cash-out flow, or by the applicable payment provider at the time of the transaction. StoryForge is not responsible for fees, exchange rates, delays, or other conditions imposed solely by third-party payment providers.

8.14 Finality of Certain Transactions

Except where required by law, all purchases of Credits are final and non-refundable once completed, and all conversions of Credits to Quills are final once processed.

8.15 No Bank Account or Fiduciary Relationship

Credits, Quills, reward balances, and any other in-platform units or balances are part of a limited digital feature environment provided by StoryForge. They are not bank accounts, deposits, stored value accounts, escrow accounts, or fiduciary accounts, and they do not earn interest.

8.16 Fraud, Abuse, and Self-Dealing Prohibited

You may not manipulate or abuse Feedback Bounties, Credits, Quills, or cash-out features. Prohibited conduct includes attempting to respond to your own bounty through another account, colluding with others to farm rewards, creating fake or duplicate accounts, using automated systems, bots, or AI-generated content to respond to Feedback Bounties or to create User Content submitted through the Services, in violation of our AI Statement, laundering value through sham activity, or otherwise attempting to game the system.

StoryForge may investigate suspected abuse and may suspend accounts, withhold or reverse Credits or payouts, cancel bounties, require additional verification, and take any other action permitted by these Terms or law.

9. Reliance on Information; Service Availability

Information made available through the Services is provided for general informational purposes only. StoryForge does not warrant the accuracy, completeness, usefulness, or reliability of any content provided by users or third parties. Your reliance on the Services or any content is at your own risk.

We do not guarantee that the Services or any content will always be available, uninterrupted, timely, secure, or error-free. We may suspend, withdraw, discontinue, or change all or any part of the Services at any time without liability.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES, ALL CONTENT, AND ALL FEATURES, INCLUDING FEEDBACK BOUNTIES, CREDITS, QUILLS, AND CASH-OUT FUNCTIONALITY, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

STORYFORGE DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, OR THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM STORYFORGE OR THROUGH THE SERVICES WILL CREATE ANY WARRANTY NOT EXPRESSLY MADE IN THESE TERMS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL STORYFORGE OR ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SUCCESSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF STORYFORGE AND ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUCCESSORS FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO STORYFORGE THROUGH THE SERVICES DURING THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain warranty disclaimers or limitations of liability. In those jurisdictions, some of the foregoing limitations may not apply to you to the extent prohibited by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless StoryForge and its affiliates, licensors, service providers, officers, directors, employees, agents, and successors (collectively, "Indemnified Parties") from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees, including reasonable attorneys' fees, arising out of or relating to:

  • your use of or inability to use the Services;

  • your User Content, including any claim that your User Content infringes, misappropriates, or violates the intellectual property, privacy, publicity, or other rights of any third party;

  • your violation of these Terms, our Privacy Policy, our AI Statement, or our Content and Community Standards;

  • your participation in Feedback Bounties, including as an Author or Responder;

  • your violation of any applicable law or regulation; or

  • any claim by another user arising from your conduct on or through the Services.

This indemnification obligation does not apply to the extent that a claim arises from StoryForge's own gross negligence or willful misconduct.

StoryForge reserves the right, at its own expense, to assume exclusive control of the defense and settlement of any matter subject to indemnification by you. You agree to cooperate fully with StoryForge in the defense of any such claim and not to settle any such claim without StoryForge's prior written consent.

13. Governing Law and Jurisdiction 

All matters relating to the Services and these Terms of Service, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Delaware without giving effect to any choice or conflict of law provision or rule (whether of the State of Delaware or any other jurisdiction).

Any legal suit, action, or proceeding arising out of, or related to, these Terms of Service or the Services shall be instituted exclusively in the federal courts of the United States or the courts of the State of Delaware, in each case located in the County of Kent, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms of Service in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

14. Arbitration; Class Action Waiver

Please read this section carefully. It affects your legal rights.

14.1 Mutual Agreement to Arbitrate. Except as provided in Section 14.4, you and StoryForge agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or any transaction or relationship between you and StoryForge — including disputes about the validity, applicability, or enforceability of this arbitration agreement — will be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. The arbitration will apply Delaware law.

14.2 Class Action Waiver. You and StoryForge each waive any right to bring or participate in any class action, collective action, or representative proceeding. Arbitration will be conducted on an individual basis only. The arbitrator may not consolidate claims of more than one person or preside over any class or representative proceeding. If this class action waiver is found unenforceable as to any claim, that claim must be litigated in court rather than arbitrated, and the remainder of this Section 14 will continue to apply to all other claims.

14.3 Opt-Out Right. If you do not wish to be bound by this arbitration agreement, you must notify StoryForge in writing within 30 days of first agreeing to these Terms. Your written opt-out notice must be sent to admin@storyforge.com with the subject line "Arbitration Opt-Out" and must include your name and the email address associated with your account. If you opt out, you and StoryForge retain the right to litigate disputes in court under Section 13. Opting out will not affect any other part of these Terms or your ability to use the Services.

14.4 Exceptions. Notwithstanding the foregoing, either party may bring an individual claim in small claims court if the claim qualifies. Either party may also seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights, confidentiality obligations, or platform security — without waiving the right to arbitrate all other claims.

14.5 Fees. The AAA's Consumer Arbitration Rules govern the allocation of arbitration fees. For claims initiated by you, StoryForge will pay all AAA filing, administration, and arbitrator fees for claims that do not exceed $10,000, unless the arbitrator determines that your claim was frivolous or brought in bad faith.

14.6 Changes to This Section. If StoryForge materially changes this Section 14, you may reject the change by sending written notice to admin@storyforge.com within 30 days of the change taking effect. Rejecting a change does not affect the rest of these Terms or your use of the Services; the prior version of this Section 14 will apply to any dispute for which you have submitted written rejection.

15. Limitation on Time to File Claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF SERVICE OR THE SERVICES MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED TO THE FULL EXTENT PERMITTED UNDER THE LAW.

16. Waiver and Severability 

No waiver by StoryForge of any term or condition set out in these Terms of Service shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of StoryForge to assert a right or provision under these Terms of Service shall not constitute a waiver of such right or provision.

If any provision of these Terms of Service is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Service will continue in full force and effect.

17. Entire Agreement 

These Terms, together with our Privacy Policy, AI Statement, and Content and Community Standards, constitute the entire agreement between you and StoryForge regarding the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Services.
